Joygo OÜ, registry code [insert registry code], address [insert company address] (hereinafter referred to as the Service Provider), and the customer who places an order in the online store and identifies themselves by entering their personal data in the order (hereinafter referred to as the Service User), have entered into these Online Store Terms & Conditions (hereinafter referred to as the Terms).

1. Online Store

1.1. The online store created by the Service Provider through which products are sold to the Service User.

2. General Provisions

2.1. In regulating their mutual relations, the parties shall be guided by the Law of Obligations Act of the Republic of Estonia, other applicable laws of the Republic of Estonia, other legal acts, and these Terms.
2.2. The Service Provider has the right to make changes to the online store services offered at any time.
2.3. The Service Provider has the right to unilaterally amend these Terms without the obligation to notify the Service User separately by e-mail.
2.4. The Service User has the right to download or print these Terms, thereby ensuring the possibility to store and reproduce the relevant information on a durable medium.

3. Products and Placing Orders

3.1. Products displayed in the online store are generally in stock. The availability of displayed products may change due to technical issues in warehouse management or online store software.
3.2. If a product is out of stock, the order cannot be fulfilled. In such a case, an employee of the online store will contact the Service User and offer a possible new delivery time, replacement with an equivalent product of the same price and quality, or a refund no later than within 14 days.
3.3. Product images displayed in the online store are illustrative and may differ from the actual product. The Service Provider makes every effort to display product descriptions as accurately as possible; however, product descriptions in the online store may not always be exhaustive and may contain unintentional errors.
3.4. Products offered in the online store are sold to both natural persons and legal entities.
3.5. The Service User selects the desired products and undertakes to enter the information required for fulfilling the order (surname, first name, contact phone number, contact e-mail, delivery address, postal code), and to pay for the products using the selected payment method.
3.6. The Service User undertakes to provide truthful and accurate information necessary for fulfilling the order. The Service Provider shall not be liable for failure to fulfill the order or for any consequences resulting therefrom if caused by incorrect information submitted by the Service User.
3.7. The sale is deemed completed when the Service User has paid for the order by bank transfer or through the payment link available in the online store.

4. Prices

4.1. All prices in the online store are in euros and include VAT.
4.2. The Service Provider has the right to change displayed prices at any time. If the Service User has placed and paid for an order, the Service Provider undertakes to deliver the corresponding products at the prices valid at the time the order was placed.
4.3. The Service Provider has the right to refuse to fulfill an order in the event of a technical error that caused an incorrect product price to be displayed in the online store.

5.1. The Service User has the right to choose between different delivery methods for goods. International shipments are delivered by courier.
5.2. Goods are delivered to the Service User within the Republic of Estonia within the delivery time indicated on the product page.

6. Withdrawal from the Contract Before Performance by the Service Provider

6.1. If the Service User wishes to withdraw from the contract after placing the order and before the Service Provider has performed its obligations, the Service User undertakes to notify the Service Provider as soon as possible. The notice must be sent to the Service Provider’s e-mail address [insert support email]. The e-mail must indicate the order number from which withdrawal is requested and include the Service User’s contact details (first name, surname, order date, contact phone number).
6.2. If the notice of withdrawal reaches the Service Provider after the Service Provider has fulfilled the contract, withdrawal from the contract shall take place in accordance with the chapter “Right of Return” of these Terms.
6.3. The Service Provider shall refund the amount paid to the Service User no later than within 14 days from receipt of the withdrawal request.
6.4. The refund shall be made to the same bank account from which the payment was originally received by the Service Provider.
6.5. The Service Provider has the right to withdraw from the contract or terminate the contract if the ordered goods are out of stock.
6.6. The Service User shall be informed of the withdrawal from or termination of the contract without delay by phone, e-mail, or post. In such a case, advance payments made by the Service User shall be refunded to the Service User’s bank account without delay, but no later than within 14 days.

7. Right of Return

7.1. The customer has the right to withdraw from the transaction within 14 calendar days after receiving the goods. The customer is obliged to return the product to the seller within 30 days from submission of the return request.
7.2. The returned product must be free of defects, complete, in its original packaging, and unused.
7.3. To return a product, the customer must submit a corresponding request by e-mail to [insert support email], and send the returnable goods together with the packaging to [insert return parcel locker / return address / pick-up point details].
7.4. The purchase invoice must be presented when returning the goods.
7.5. When the return reaches us, we will send confirmation of receipt of the parcel to your e-mail address. The refund for the returned goods will be transferred to your bank account within 5 working days from receipt of the returned goods. Refunds are made to the same bank account from which the payment for the order was made.
7.6. The refund shall be made to the same bank account from which the payment was received by the Service Provider.
7.7. Transportation costs related to the return shall be borne by the Service User unless otherwise required by applicable law.

8. Complaints and Claims

8.1. Products sold in the online store are subject to a 2-year claim period as provided in § 218 (2) of the Law of Obligations Act.
8.2. The Service Provider shall not be liable for damage caused by improper use of the ordered products, nor for delays in delivery if caused by circumstances beyond the Service Provider’s control and/or force majeure.
8.3. The handling of exchanges and returns may take up to 7 days.
8.4. Consumer Sales Claims
In the case of consumer sales, the seller is liable for any non-conformity of the goods with the contract terms that becomes apparent within 2 years from the delivery of the goods to the consumer. In consumer sales, it is presumed that any non-conformity that becomes apparent within six months from the date of delivery existed at the time of delivery, unless such a presumption is contrary to the nature of the goods or the defect. When a defect appears, the trader is required by law during the first six months to prove the absence of a manufacturing defect at the time of delivery. For this purpose, the trader may provide its own expert assessment or order an examination from an independent expert. The legal presumption is contrary to the nature of the defect especially where the defect has arisen from normal wear and tear, improper handling, or an accident. After six months have passed, the consumer must justify and prove that the non-conformity existed at the time of delivery, i.e. that the trader sold defective goods. The seller is not liable for a defect arising after an unusually short period of use if the goods have been used with significantly greater intensity than could reasonably be expected from a consumer under normal circumstances.

9. Privacy Policy / Data Security

9.1. The Service User gives clear and informed consent to the Service Provider for the processing of their personal data.
9.2. Personal data entered by the Service User when placing an order and thereby made known to the Service Provider shall be entered into the customer register and used for providing sales services and offering goods to the Service User.
9.3. Secure SSL data communication and applicable payment security systems are used when card data are requested.
9.4. The Service Provider does not have access to the card data entered by the customer. To complete the transaction, the cardholder is directed to the secure environment of the payment service provider. At the moment of payment, the cardholder enters card data directly into the payment service provider’s server environment, and such data are stored there in accordance with the provider’s security standards.
9.5. The source of personal data is the establishment of the customer relationship upon registration of an order in the online store.
9.6. Registered personal data may include the purchaser’s first name, last name, address, phone number, year of birth, delivery method, payment method used, and confirmation of acceptance of the online store terms.
9.7. Personal data are processed by Joygo OÜ.
9.8. Personal data necessary for delivering the goods to the Service User are forwarded to companies providing courier and delivery services.
9.9. The protection of personal data is ensured by appropriate security measures.
9.10. The Service Provider undertakes not to disclose registered personal data to unauthorized third parties.
9.11. The Service Provider reserves the right to disclose data concerning the Service User if the data are processed by a person who has a legal right to do so in order to fulfill an obligation prescribed by law, or if this is necessary to protect the life, health, or freedom of the Service User.
9.12. The Service User has the right to review the personal data concerning them, as well as to amend or remove such data from the register in accordance with applicable law.
9.13. The Service User consents to the Service Provider sending an order confirmation to the e-mail address entered when placing the order.
9.14. The Service User consents to the Service Provider sending promotional offers to the e-mail address entered when placing the order, provided that the Service User has given the corresponding consent by ticking the appropriate box on the order page.

10. Liability

10.1. The Service Provider’s liability is limited to the sales price of the product.
10.2. The Service User undertakes to use the online store service only for purposes that comply with the law and good practices.
10.3. The Service User is solely responsible for obtaining and maintaining all software and data communication systems necessary for use, as well as for any other costs arising from the use of the online store service.
10.4. The Service User is fully liable for any damage caused by use of the online store contrary to law or good practices, whether such damage is caused to the Service Provider, other Service Users, or third parties.

12. Disputes
